The Investment Visa Explosion: The E2

Most of our clients are homeowners with substantial equity of $100,000 or more, they are excellent potential clients for us. The US government wants to encourage investment into its economy because 80% of the US economy is made up of small business. Therefore, Aliens looking to buy a business, or start their own business in the US are highly favored.

The E2 visa is a great visa because once acquired it can be renewed every two years indefinitely. Another important benefit is that unlike employment visas such as the H-1B (for BA graduates & skilled trade workers) the spouse of an E2 visa holder can apply for a work permit and work for anyone and this often leads to the spouse obtaining  green cards for the entire family. Again, in contrast, H-1B spouses cannot even open their own bank account let alone work or obtain any form of credit.

With the E2 you don't need a BA degree or equivalent. You don't need to find an employer willing to hire you. Instead, you simply buy or invest your way into the US. The key requirement for this visa is that  within 5 years your business will, if successful, provide at least two jobs for US citizens in addition to your own job. If your business can meet this requirement you're 90% the way there.

Another popular investment type visa is the L1-A visa. In a nutshell, this visa is very similar to the E2 two, in that it requires the applicant to buy or start up a business and create employment, but with the L1A, if the new business is an extension of the alien's business at home (creating a new branch) then the business owner will be allowed to upgrade from L1-A to Green card after the first year.

In conclusion, you're always going to find the odd rare except where a BA graduate - or skilled worker  has found an employer willing to hire them and wait for as long as it takes to go through the paperwork, but for the vast majority of people that's not their experience. In my professional opinion the E2 and L1A are currently providing the very best realistic option for long term relocation to the US.
